Arctic Refrigeration Inc. warrants to the purchaser 30-day parts and labor on all commercial units, under normal use that the equipment is designed for, from the date of purchase. Our obligation under this warranty shall be limited to repairing or replacing, including labor, any part of such product which proves to be defective and which Arctic Refrigeration Inc. examination shall disclose to our satisfaction to be defective. The labor warranty shall be for standard straight time only and reasonable travel cost.
No repairs are to be made in warranty by any other personnel other than Arctic Refrigeration Inc. employees.
Improper operation due to low voltage conditions, inadequate wiring, and accidental damage are not equipment defects and are strictly the responsibility of the purchaser.
Condenser coils must be cleaned at regular intervals. Failure to do so can cause compressor malfunction and will void warranty.
No claims can be made against this warranty for spoilage of products, loss of sales, or consequential damages. These warranties are in lieu of all other warranties, express or implied, and all other obligations or liabilities on our part, and we neither assume nor authorize any other person to assume for us any obligation or liability in connection with the sale of said refrigeration units or any parts thereof. This warranty shall not be assignable and shall be honored only in so far as the original purchaser. This warranty does not apply outside the limits of the United States and its territories and Canada, nor does it apply to any part which has been subject to misuse, neglect, alteration, accident, or to any damage caused by transportation, flood, fire, or acts of God.
Purchaser agrees that certain equipment and materials described in this Purchase Agreement and Work Order (hereafter referred to as Agreement), being sold by Arctic Refrigeration Inc. and purchased by customer, are to be installed on the premises of Customer and may be attached to, integrated into, or hooked up to the building, premises or existing equipment of Customer. Customer unconditionally agrees that Arctic Refrigeration Inc. retains ownership of all equipment and materials being sold by the Agreement until paid for in full by customer. If customer does not pay for the materials and equipment upon the terms and at the times required by this Agreement, then upon giving 24-hours notice to customer, Arctic Refrigeration Inc. has the right to enter upon the premises of customer during normal business hours and remove the equipment and materials described in this Agreement. Customer further agrees that Customer is liable for and shall pay to Arctic Refrigeration Inc. the full amount due under this Agreement, less the value of any salvaged or repossessed equipment obtained by Arctic Refrigeration Inc. at the fair market value of the equipment or materials in the condition as removed from the premises of customer. Further, customer agrees that Arctic Refrigeration Inc. is not liable for any damages to the premises, equipment, or business of customer by such removal, including no liability for lost profits, lost customers, lost business, lost chance of business, or for any other losses sustained by customer as a result of such removal. Customer shall indemnify and hold harmless Arctic Refrigeration Inc. from and against any claims against Arctic Refrigeration Inc. arising out of the removal of equipment or materials under the terms of this agreement. Arctic Refrigeration Inc. retains the right to repossess and obtain the equipment and materials sold by this Agreement for a period of 12 months from date of purchase. A finance charge or 1.5% per month will be added to the billing for all accounts which are not paid in a timely manner (90 days overdue). Should Customer’s account be placed in the hands of an attorney for collection for non-payment, Arctic Refrigeration Inc. shall recover the amount of this Agreement, plus interest, costs of collection, and any attorney’s fee incurred by Arctic Refrigeration Inc.
